Restructuring, transformation

Restructuring and transformation are core areas of our employment-law practice. With our support, even complex employment-law change processes are completed within time and budget. We accompany the whole project throughout – from the planning stage to the information and negotiation stage and finally to implementation.

We support all forms of restructuring, including complex conversions or post-merger situations, with our expertise in collective bargaining, works constitution and co-determination law acquired over decades in a large number of restructuring projects. Our broad experience of acting in the stakeholder role enables us to structure the transformation processes involved.

Our toolbox includes adjustments of enterprise and establishment structures, alterations of collective pay rates and employment conditions and also tried and tested programmes to address the workforce and obtain volunteers for redundancy. We also support requalification initiatives and the harmonisation of occupational pension plans.

We conduct negotiations on the reconciliation of interests and redundancy schemes and on proceedings before conciliation bodies, and we negotiate collective social plans. In advance, in consultation with you, we prepare the negotiation strategy including any necessary Plan B.

Our clients appreciate our energetic enforcement approach. On request we will accompany the realisation of your project by setting up a custom change office. At your own choice and based on the demands of the project, this change office may support you in various ways: in drafting and entering into severance agreements, preparing works council hearings, conducting official participation procedures, conducting employee interviews, preparing certificates and in connection with any necessary notices of mass redundancy (including planning strategies to avoid the notice of mass redundancy and the monitoring necessary for this). We have strong personnel resources and can activate them at short notice. We are therefore ready at any time – for example where there are internal capacity bottlenecks – to support you and also to conduct negotiations for you with employees within a framework laid down by yourself.

Our experienced network comprises long-term and confirmed contacts to qualification and transfer companies, mediators and conciliation committee heads, suppliers of further training and outplacement, and seasoned HR interim managers.
